Terms of Service

Thank you for visiting Boya Porcelana. These Terms of Service govern the use of the website boyaporcelana.com and the purchase of products and workshops through it. By placing an order or registering for a workshop, you accept these terms, so please read them carefully before proceeding.
1. Owner information
In accordance with Article 10 of Spanish Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE), the identification details of the owner of this website are:

2. Purpose
These terms govern:
- the purchase of handcrafted porcelain pieces through the online shop
- custom orders made by the owner
- registration and participation in in-person workshops, both at our studio in Valencia and at external locations
- general use of the website and related services
3. Acceptance and users
To make a purchase or register for a workshop you must:
- be at least 18 years old or, if a minor, have authorisation from your legal representative
- have legal capacity to enter into a contract
- provide truthful and up-to-date information
By completing an order, you expressly accept these terms, the Privacy Policy and the Cookie Policy.
4. Products
All our products are handmade porcelain pieces. This means that:
- each piece is unique: small variations in shape, colour, texture or finish are inherent to the artisanal process and do not constitute defects
- the colours shown in the photographs may vary slightly depending on the screen on which you view them
- when a piece is in stock it is shipped directly; when it is made to order, the production time is indicated on the product page
5. Purchase process
To make a purchase you follow these steps:
- select the products and add them to the cart
- review your order and enter your shipping and billing details
- choose the payment method and confirm the purchase
- receive an email confirming your order
The purchase contract is concluded the moment you receive the confirmation email. This email serves as proof of the order on a durable medium, in accordance with Article 98 of the Spanish Consumer Protection Act (TRLGDCU).
We reserve the right to refuse or cancel orders in exceptional cases, for example if we detect obvious errors in the price or description, product unavailability or suspected fraud. In such cases we will inform you and, if you have already paid, refund you in full.
6. Prices and payment
- All prices shown on the website include applicable VAT
- Shipping costs are calculated during the purchase process, according to the flat rate applicable to your region (detailed in the FAQ section and the Shipping Policy), and are shown before you confirm payment
- We accept the payment methods listed on the payment page
- Payments are processed through secure gateways; we do not store card data
For orders shipped outside the European Union, customs duties, import taxes or other local fees may apply. These are payable by the buyer and are not included in the price on our website.
7. Shipping
We ship worldwide. Exact costs and delivery times are published in the FAQ section and the Shipping Policy, and are confirmed during the purchase process before payment.
The times indicated are approximate. We are not responsible for delays at customs or caused by the shipping company once the parcel has left our studio. In any case, if a shipment suffers a significant delay, we will contact you to find a solution.
8. Withdrawal and damaged products
Right of withdrawal
As a consumer you have the right to withdraw from your purchase within 14 calendar days of receiving the order, without justification, in accordance with Article 102 TRLGDCU.
How to exercise it:
- write to us at studio@boyaporcelana.com indicating the order number and your intention to withdraw, before the 14-day period expires
- we will provide you with the return address and packaging instructions
- return shipping costs are at your expense
- the piece must be returned packaged according to our instructions: due to the fragility of porcelain, this is essential for it to arrive in the same condition in which it was sent
- once we receive the piece and verify its condition, we will refund the amount paid by the same payment method you used, within a maximum of 14 days
Exceptions to the right of withdrawal
In accordance with Article 103 TRLGDCU, there is no right of withdrawal for custom orders or orders made to your specifications (see section 9).
Damaged or defective pieces
If you receive a piece that is broken, damaged or defective, write to us at studio@boyaporcelana.com within 14 days of receipt, attaching photographs of the outer packaging and of the damage. In these cases you can choose between:
- having a new piece sent at no additional cost, or
- a full refund of the amount paid, including shipping costs
This coverage is in addition to the three-year statutory conformity guarantee provided for in Article 120 TRLGDCU.
9. Custom orders
We make pieces to order based on the client's specifications. The process is as follows:
- Initial consultation: we discuss your idea, dimensions, finishes, intended use and timeline
- Sketches: we prepare sketches for your approval, at no cost or commitment
- Samples: once the sketches are approved, we produce physical samples for your review
- Confirmation and first payment: when you approve the samples, we confirm the order and you make the agreed first payment
- Production and delivery: we begin final production and deliver the piece within the agreed timeframe
Important: once the samples are approved and the first payment is made, the order cannot be cancelled or withdrawn from. These are goods made to your specifications, expressly excluded from the right of withdrawal under Article 103.c TRLGDCU. By approving the samples you expressly accept this condition.
The statutory guarantee for manufacturing defects continues to apply normally to custom orders.
10. Workshops
We organise in-person workshops at our studio in Valencia and, occasionally, at other locations by invitation or in collaboration.
Registration and payment
- places are reserved on a first-come, first-served basis
- registration is confirmed once the full workshop fee is paid
Cancellation by you
- if you cancel 7 or more calendar days before the workshop date, we refund the full amount
- if you cancel less than 7 days in advance, no refund applies. In that case you may, with our prior confirmation, transfer your place to another person or move your booking to a later date, subject to availability
Cancellation by us
If for exceptional reasons we have to cancel or reschedule a workshop, we will let you know as far in advance as possible and you can choose between:
- transferring your place to the new date
- a full refund of the amount paid
During the workshop
Participants agree to follow the safety instructions provided by the instructor, to use materials and tools appropriately, and to respect the space and other attendees. Boya is not liable for damages arising from imprudent use or use contrary to instructions.
Photography and video
During workshops we may take photographs or video recordings for use on our digital channels. If you do not wish to appear, please let us know at the start of the workshop and we will respect that. For workshops involving minors, additional specific conditions apply, which we will clearly inform you of before the event.
11. Intellectual property
All website contents (text, photographs, logos, designs, videos) are the property of Bojana Brkić or used with the corresponding authorisation, and are protected by intellectual property law.
Their reproduction, distribution, transformation or commercial use without written authorisation is not permitted. For editorial use, collaborations or press, please write to us at studio@boyaporcelana.com.
Designs made for custom orders are produced for the client's use; the authorship of the pieces, including those created on commission, remains with the artist.
12. Liability and care of the pieces
Porcelain is fragile by nature. To extend the life of your pieces we recommend:
- handling them with care
- not subjecting them to sudden temperature changes, unless expressly indicated on the product page
- following the care instructions that come with each piece
Boya is not liable for damages arising from inappropriate use, drops or accidents that occur after delivery.
Our liability shall in no case exceed the amount paid for the corresponding product or service, except in cases where the law does not allow such a limitation.
13. Data protection
The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these terms.

We have official complaint forms (hojas de reclamaciones) available to consumers, as required by Spanish consumer law.
Online dispute resolution
In accordance with Regulation (EU) 524/2013, we inform you of the existence of the European online dispute resolution platform, available at: https://ec.europa.eu/consumers/odr. You can use it to resolve disputes related to online purchases.
15. Applicable law and jurisdiction
These terms are governed by Spanish law. For consumers, disputes are submitted to the courts of the consumer's domicile, in accordance with Article 90.2 TRLGDCU. For buyers who do not have consumer status, the parties submit to the courts of València, expressly waiving any other jurisdiction.
16. Languages
These terms are available in Spanish and English. In case of discrepancy between versions, the Spanish version shall prevail for legal purposes in Spain.
17. Modifications
We may modify these terms to adapt them to regulatory changes or changes in how we work. Modifications apply to orders and registrations made after their publication; orders and bookings already confirmed are governed by the terms in force at the time they were made.
